This is defined as ‘the right of using mother’s land in a defined and specific way without taking any substance from the land. A right of way is a typical easement. Easements may be positive or negative. The right of way is a positive easement, the right not to be deprived of light is a negative one. Easements are normally created by d e e d and may be express or implied. An implied easement may arise when a man sells part only of his property, an implication being that he has a right of way over the part sold to reach the part way which is still his.
